Terms of Service

1. Acceptance of Terms

Welcome to Snapeen, an event photo-sharing platform operated from the Republic of Serbia ("Snapeen," "we," "our," or "us"). By accessing or using our platform — whether as an event host (creating an account and event galleries) or as an event guest (uploading or viewing photos via a QR code, link, or PIN, with or without an account) — you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and our Fair Usage Policy. If you do not agree, do not use the service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create a host account or make a purchase. Guests under 18 may participate in an event only with the involvement of a parent, guardian, or the event host.

2. Description of Service

Snapeen allows hosts to create event galleries, generate QR codes for event access, and collect, share, display, and download photos and videos from their events. Depending on your plan, the service may also include features such as bulk download, a live photo wall or slideshow, custom event pages, and generated creations (such as collages and highlight videos).

We continually improve the platform and may add, modify, or discontinue features (in whole or in part) at any time. Where a change materially reduces the core functionality of a plan you have already paid for, we will make reasonable efforts to notify you.

3. User Accounts

3.1 Account Creation

To use certain features you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use at hello@snapeen.com.

3.3 Account Termination

We may suspend or terminate your account for violation of these Terms, our Fair Usage Policy, or applicable law. You may delete your account at any time through your account settings; deleting your account permanently deletes your events and content.

4. Plans, Payments, and Refunds

4.1 Plans and Limits

Snapeen offers a Free plan and paid per-event plans (One-Time and Premium), plus an optional Snapeen Memories subscription. Each plan has limits on the number of photos and videos, the upload window, and the gallery storage period, as described on our pricing page at the time of purchase. Upload and storage windows are measured from your event date. We may adjust plan limits and pricing for future purchases; changes do not retroactively reduce what you have already paid for.

4.2 Payment Processing

Payments are processed by our payment partner Lemon Squeezy, acting as merchant of record. Your purchase is also subject to Lemon Squeezy's terms, and applicable taxes (such as VAT) may be added at checkout based on your location. Snapeen does not store your payment card details.

4.3 Refunds

For per-event plans, we offer a refund within 24 hours of purchase provided you have not yet generated your event QR code. Once your QR code is generated or your event begins collecting photos, the service is considered performed and sales are final, except where a refund is required by applicable consumer law. By purchasing, you expressly request immediate performance of the digital service and acknowledge that you thereby lose any statutory right of withdrawal once performance has begun, to the extent permitted by law.

4.4 Snapeen Memories Subscription

Snapeen Memories is a recurring subscription that renews automatically (monthly or yearly, as chosen at purchase) until cancelled. You can cancel at any time from your dashboard or via the billing portal; cancellation takes effect at the end of the current billing period, and no partial-period refunds are provided unless required by law. If your subscription ends, your content becomes subject to the standard storage periods of your event plans, and content already past its storage period may be deleted after a short grace period.

5. User Content

5.1 Your Content and License to Us

You retain all rights to the photos, videos, and other content you upload ("Your Content"). By uploading, you grant Snapeen a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, and display Your Content solely for the purpose of operating and providing the service — including creating technical copies and derivatives such as thumbnails and previews, generating host-requested creations (such as collages, slideshows, and highlight videos), and making Your Content available to the event's host and participants, including on shared displays such as a live photo wall where the host enables them. This license ends when Your Content is deleted from the service, except for residual copies in backups pending their normal deletion cycle. We will not use Your Content for our own marketing without your explicit permission, and we do not use it to train AI models.

5.2 Your Warranties and Responsibilities

You represent and warrant that you own or have the necessary rights to upload Your Content, and that Your Content will not:

• Violate any third-party rights, including copyright, trademark, privacy, personality, or publicity rights — including the rights of people who appear in your photos
• Contain unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable material
• Contain sexually explicit material, or any content depicting the exploitation or abuse of minors (which we will report to authorities)
• Contain viruses, malware, or other harmful code
• Depict or encourage illegal activities, or violate any applicable laws or regulations

5.3 Consent of People in Photos

Event photos naturally include images of other people. As between you and Snapeen, the uploading guest and the event host are solely responsible for ensuring that people appearing in uploaded content are informed and, where required by applicable law, have consented to being photographed and shared within the event gallery. Hosts agree to inform their guests that photos taken at the event may be uploaded to a shared gallery. Snapeen acts as a neutral platform and does not review who appears in uploaded content.

5.4 Content Monitoring and Removal

We do not pre-screen content, and we are not obligated to monitor it. However, we reserve the right to review, remove, or disable access to any content that we reasonably believe violates these Terms, our Fair Usage Policy, or applicable law — at our sole discretion, with or without notice.

5.5 Backup, Storage, and Automatic Deletion

Event photos, videos, and all associated media are automatically and permanently deleted at the end of your plan's storage period, measured from your event date:

• Free plan: 30 days after the event date
• One-Time plan: 12 months after the event date
• Premium plan: 12 months after the event date

An active Snapeen Memories subscription extends storage for as long as the subscription remains active (see Section 4.4). Upload windows are separate from storage windows and are also plan-dependent, as described on the pricing page.

Once deleted, content cannot be restored by you or by Snapeen under any circumstances. Snapeen is not a backup or archival service. You are solely responsible for downloading and maintaining your own copies of Your Content before your storage period expires. To the maximum extent permitted by law, Snapeen is not liable for any loss of content resulting from automatic deletion, expiration of storage periods, account termination, technical failure, or any other cause.

We will make reasonable efforts to notify event hosts by email before their content is deleted, but we do not guarantee delivery of such notifications, and failure to receive a notification does not extend the storage period or create any liability for Snapeen.

6. Event Access and Management

6.1 Host Responsibilities

Hosts control access to their events by distributing QR codes, links, and PINs. Anyone in possession of these credentials may be able to access the gallery: hosts are solely responsible for sharing them only with intended guests and accept the risk of wider access if credentials are shared publicly or forwarded by guests.

6.2 Guest Participation

By joining an event via its QR code, link, or PIN — including uploading without an account — you accept these Terms and agree that content you upload will be visible to the host and other event participants, and may appear on shared displays (photo wall, slideshow) at the event. Only upload content you are comfortable sharing with everyone at the event, and note that other participants may download content the host makes available for download.

7. Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems, other users' accounts, or events you were not invited to
• Interfere with or disrupt the service, servers, or other users' events
• Use automated means (bots, scrapers, bulk-upload scripts) to access or use the service without our written permission
• Collect or harvest personal information or media about other users beyond normal event participation
• Impersonate another person or entity, or misrepresent your affiliation with an event
• Resell, sublicense, or commercially exploit the service without a written agreement with us
• Circumvent plan limits, storage periods, or security measures
• Upload malicious code or engage in any activity that could damage or impair the service

8. Intellectual Property

The Snapeen platform — including its design, logo, name, features, software, and functionality — is owned by us and protected by copyright, trademark, and other intellectual-property laws. Except for the limited right to use the service as intended, no rights are granted to you. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on our service without our express written permission.

9. Privacy

Your use of the service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information, and by our Fair Usage Policy.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

The service is provided 'as is' and 'as available' without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free, or that content will always be available or preserved. Scheduled maintenance, outages, or third-party failures (hosting, payment, email providers) may temporarily affect the service.

10.2 Limitation of Liability

To the maximum extent permitted by law, Snapeen and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data (such as photos or videos), loss of profits, revenue, goodwill, or emotional distress — arising from or related to your use of, or inability to use, the service. Our total aggregate liability for all claims shall not exceed the amount you paid us in the twelve months preceding the claim (or, if you have paid nothing, EUR 25). Nothing in these Terms excludes liability that cannot be excluded under applicable law, including mandatory consumer rights.

10.3 User Content Disclaimer

Content in event galleries is created and uploaded by users, not by Snapeen. We are not responsible for user-generated content, do not endorse it, and make no representations about its accuracy or legality. Any disputes about uploaded content (for example, a person objecting to a photo of themselves) are primarily between the people involved and the event host; we will assist with removal as described in our Privacy Policy. You use the service and access user content at your own risk.

11. Indemnification

You agree to indemnify, defend, and hold harmless Snapeen and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from Your Content, your use of the service, your violation of these Terms, or your violation of any third-party rights — including claims by people appearing in photos you uploaded or in events you hosted.

12. Copyright Complaints

We respect intellectual-property rights. If you believe content on our platform infringes your copyright, contact us at hello@snapeen.com with:

• Identification of the copyrighted work
• Identification of the infringing material and its location (event/gallery link)
• Your contact information
• A good-faith statement that the use is not authorized
• A statement that the information is accurate and that you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We will remove or disable access to infringing material where appropriate and may terminate repeat infringers' accounts.

13. Termination

We may suspend or terminate your access to the service immediately, without prior notice, if you breach these Terms, our Fair Usage Policy, or applicable law, or where necessary to protect the service or other users. Upon termination, your right to use the service ceases and your content may be deleted; where reasonably possible and lawful, we will give you an opportunity to download your content first. Sections that by their nature should survive termination (including licenses needed to complete deletion, disclaimers, limitations of liability, and indemnification) survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law provisions. Disputes shall be subject to the exclusive jurisdiction of the competent courts in Serbia — except that if you are a consumer, you retain any mandatory rights and venue protections granted by the consumer-protection laws of your country of residence. Before starting any formal proceedings, please contact us — most issues can be resolved directly.

15. Changes to Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the 'Last updated' date; for material changes we will make reasonable efforts to notify account holders (for example by email or in-app notice) in advance. Your continued use of the service after changes take effect constitutes acceptance. If you do not agree to the changes, stop using the service and, if applicable, download your content and delete your account.

16. General Provisions

• Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force
• Entire Agreement: These Terms, together with the Privacy Policy and Fair Usage Policy, constitute the entire agreement between you and Snapeen regarding the service
• No Waiver: Our failure to enforce any provision is not a waiver of our right to enforce it later
• Assignment: You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets
• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control
